1. Acceptance and purpose
Signing in with an AI² account, registering or accepting access to a company constitutes acceptance of this Agreement. You confirm legal capacity, an age of at least 18 and authority to act for the business. The Agreement remains in effect until use of the Service ends and outstanding obligations are fulfilled.
The Service is intended for companies, sole proprietors and self-employed persons in their professional activities. If applicable law recognises You as a consumer, all mandatory consumer rights remain, including withdrawal, conformity of services and statutory refunds.
2. Features and staff access
The Service enables management of agents and their conversations with clients, events and requests (INS), setting rules, instructions and tasks, use of a knowledge base, human takeover of conversations and return to the agent, notifications, conversations with and calls to agents. NOVA is the group of companies' digital employee, available in every user's contacts; NOVA is neither a human nor a separate contracting party. Working with TwinCard and AI² Fans data through the Service is also governed by those services' documents.
Only the company owner maintains its access registry. The owner grants, changes and revokes access through a verified email address or an individual key. Each key is strictly for one person and only for the specified agent and permissions; there is no team key. Giving a key instructs the Operator to grant that access. Staff act for the business and may work from any country within their permissions; their country does not reduce the work information available to them. The business is responsible for their actions and timely revocation of access. Do not share passwords, keys or accounts; report any compromise to the Operator immediately.
3. AI and business responsibility
Responses are generated by the Operator's own models on its servers. An AI employee is not a human; responses, including spoken responses, may contain errors and do not guarantee an outcome. The business verifies important responses, provides human oversight and informs clients that AI is used. Human responses during takeover are labelled accordingly.
The business is responsible for the legality, accuracy and rights to supplied materials, instructions, tasks and information its agents give clients. Creating a custom voice requires the person's explicit consent. The Operator is not a party to transactions between the business and its clients and is not responsible for the business's goods, services or obligations.
4. Integrations and notifications
Webhooks, API keys and other available integrations are connected by the business. Transfers to its chosen recipients follow its instructions; the business is responsible for recipients, settings and keeping secrets secure. The Operator may limit requests or suspend an unsafe integration. Notifications about clients, INS, access, payments and security are sent through the Service, email and push notifications You permit. The Operator's marketing messages require any consent required by law; You may opt out.
5. Data and processing instructions
Data processing is described in the Privacy Policy: https://aironik.ai/privacy. The Operator is independently responsible for account, payment and security data processing. For the personal data of the business's clients, the business is the controller (data operator); the Operator processes data on its behalf only to provide Service features, without using them for its own purposes.
GDPR, including Article 28 and Chapter V, and applicable data protection rules apply. Processing terms, safeguards, assistance with data subject requests, incident notifications, infrastructure providers and erasure are governed by the data processing appendix to the user agreement of the service in which the agent was created, as stated in the Privacy Policy. Using AIRONIK does not replace or expand those instructions. The business ensures lawful grounds for processing personal data and informs clients. Company information and an ordinary product question are not in themselves personal data; information about an identifiable person is protected by applicable law. Granting staff work permissions is a business decision and is not documented as separate business consent to personal data processing.
6. Prohibited use
Unlawful activities, fraud, spam, discrimination, violence and exploitation, infringement of rights or confidentiality, presenting AI as a human, uploading personal data without lawful grounds, unauthorised access, bypassing safeguards, malicious code and interference with the Service are prohibited. Copying or reverse engineering the software is prohibited except as permitted by law. The Operator may remove infringing content, restrict or suspend access, explaining the reasons and appeal procedure; security threats may require immediate action. Appeals are sent to support. If the account is blocked for a breach of the Agreement, termination of the subscription and refunds of AI² tokens are governed by clause 8.8.
7. Rights to materials
The Operator owns or lawfully uses rights to the software, models and design. You receive a non-exclusive right to use available features for the business during this Agreement. Rights to business materials remain with their holders; the business authorises the Operator to store, process and display them only to provide ordered features. This authorisation ends when materials are deleted, subject to lawful retention periods. AI responses are not guaranteed to be unique.
8. Tariffs, subscriptions and refunds
8.1. Subscription. Paid features of the Service are provided by subscription. The User selects the subscription term when subscribing from the terms shown on the payment page.
8.2. Payment and Wallet. The subscription is paid for in AI² tokens from the Wallet of the Service. The Wallet of the Service is separate from the wallets of the Operator’s other services: funds in one service are not used to pay for another.
8.3. Automatic renewal. At the end of the paid period, the subscription renews automatically for the same term at the price applicable on the renewal date, by debiting the Wallet of the Service. The User receives notice of the upcoming renewal 3 (three) days before the end of the paid period.
8.4. Insufficient funds. If the Wallet balance is insufficient on the renewal date, no debit is made, the User is notified, automatic renewal is disabled, and access to paid features ends at the end of the paid period. Topping up the Wallet after this does not automatically reactivate the subscription — the User must subscribe again.
8.5. Disabling renewal. The User may disable automatic renewal at any time in the “Subscription” section. The paid period remains in effect until its end; no refund is made.
8.6. Cancellation of the subscription. The User may cancel the subscription at any time. Upon cancellation, access to paid features ends immediately, and AI² tokens are refunded to the Wallet from which payment was made:
- if no more than 24 (twenty-four) hours have elapsed since payment — the full price of the paid period;
- if more time has elapsed — the price of the unused portion of the paid period, in proportion to the time remaining.
8.7. Account deletion. Upon deletion of the account or removal of the Service from the account, the active subscription is cancelled in accordance with clause 8.6.
8.8. Blocking. If the account is blocked for a breach of this Agreement, the active subscription ends and the price of the unused portion of the paid period is refunded to the Wallet of the Service.
8.9. App stores. A subscription purchased through App Store or Google Play is renewed, has renewal disabled, and is cancelled in the subscription settings of the relevant store; refunds are subject to that store’s rules.
8.10. Consumer rights. This section does not restrict the User’s rights under applicable consumer protection law. This includes the right to withdraw from the contract within 14 days under Directive 2011/83/EU, insofar as that right has not ended as a result of the User’s consent to the immediate commencement of the service.
AI² tokens are internal service accounting units, not money or investment instruments. They are not exchanged back into money, except in cases provided for by law or in cases of technical failure or duplicate charging attributable to the Operator. This rule does not restrict refunds of the subscription price in AI² tokens to the Wallet under clauses 8.6–8.8. Where there are legal grounds, refunds of non-cash payments are made to the same bank account. To request a monetary refund, the User sends support the reason and transaction details; eligible refunds are made within 14 days after approval of the request.
9. Availability and liability
The Operator takes reasonable measures to operate and protect the Service but does not guarantee uninterrupted availability, absence of errors or a particular result. Maintenance and outages may occur; the business keeps necessary copies and provides alternative client communications.
To the extent permitted by law, the Operator is not liable for the business's lost profits or indirect losses; aggregate liability is limited to the amount paid for the Service in the preceding 12 months. These limits do not apply to intent, gross negligence, injury to life or health or liability that cannot legally be limited. The limits do not remove the Operator's obligation to provide paid services and statutory refunds. The business is liable for losses caused by breaches of this Agreement within applicable law.
10. Deletion and ending use
An AI² account deletion request means full erasure after 30 days, except for legally required records and anonymised statistics. Signing in within that period and confirming restoration cancels the request. Consequences for agents, pages and data are described at https://aironik.ai/delete-account. Upon deletion of the Account or removal of the Service from the account, the active subscription is cancelled with a refund of AI² tokens to the Wallet in accordance with clause 8.7. Uninstalling the Application does not delete the account. Ending use does not cancel accrued payment obligations or mandatory refund rights.
11. Changes to the Agreement
The Operator notifies You of material changes through the Application, Website, email or push notifications at least 14 days before they take effect, except for urgent legal or security changes. Changes are not retroactive and do not worsen terms for a period already paid for. Continued use after changes take effect constitutes acceptance; if You disagree, You may stop using the Service and request deletion. Mandatory rights remain. Previous versions are available on request.
12. Law, disputes and contacts
Polish law applies, subject to Regulation (EC) No. 593/2008 (Rome I) and mandatory applicable rules, including consumer protection in the consumer's country of residence. Claims are reviewed within 30 calendar days; unresolved disputes go to the competent court under applicable jurisdiction rules, including a consumer's right to sue where they reside. Consumers may contact an alternative dispute resolution body (ADR). Invalidity of one provision does not affect the others. For questions about this Agreement, access, suspension and refunds: [email protected]; the Operator's postal address and telephone are above. This Agreement is drawn up in English; translations are provided for convenience. In case of discrepancies the English text prevails, subject to mandatory rights under applicable law.
